Out of State Clients

David G. Crum & Associates, has defended clients from various states thoughout the United States. In these cases, because the alleged crime was committed in New Mexico, New Mexico has jurisdiction over the legal proceedings, even though the client is located outside of the state. The following steps are typically utilized by the out of state client who retains our law firm:

1. Contact us regarding your case by telephone or by submitting a case evaluation. You can contact us at (505) 843-7303 or toll free at 1-877-843-7303. After we have discussed your case and agreed upon your fee, you will receive a client information sheet and fee agreement by fax or e-mail, which you will sign and return to us by fax at (505) 244-8731.

2. After you have made payment pursuant to your fee agreement, we will begin work on your case immediately.

Other Important Points for Out of State Clients

MVD Hearings
It is important to understand that an administrative revocation regarding an out of state license only revokes the defendant's driving privileges in the State of New Mexico. An adverse decision from the Department of Motor Vehicles does not affect the status of your license in the issuing state. However, if you are revoked in New Mexico, it will be necessary to reinstate your driving privileges here before you can renew your license in the issuing state. A criminal conviction in New Mexico, however, can result in a revocation of your home state driver's license under the Interstate Compact.

As an out of state driver, you should still request an MVD hearing in New Mexico. This allows your attorney to obtain valuable information regarding your criminal case and to cross examine, under the oath, the officers who will be testifying against you at your criminal trial.

Waivers of Appearance for Non Trial Settings
If you are represented by legal counsel, the vast majority of New Mexico courts will allow you to waive your arraignment and other hearings prior to trial. Our firm will work closely with you to minimize your number of court appearances in New Mexico.
